About the Board

An independent review of zoning decisions

The Zoning Board of Appeals is a quasi-judicial board appointed by the Town Board. It does not rewrite the zoning law or approve ordinary development applications. Instead, it reviews specific appeals and requests for relief under the standards established by New York law and the Town’s zoning regulations.

The board’s role is to provide a formal process for property owners who believe strict application of a zoning requirement creates practical difficulty or unnecessary hardship, or who seek review of an official zoning interpretation.

Begin with the Zoning Officer. Most ZBA matters require a formal determination, denial or referral before an appeal or variance request can proceed.
Types of ZBA Review

Relief considered by the board

Area Variances

Requests for relief from dimensional requirements such as setbacks, lot size, building height, frontage or lot coverage.

Use Variances

Requests to allow a land use that is not otherwise permitted in the zoning district. New York law applies a demanding unnecessary-hardship standard.

Interpretations & Appeals

Review of an eligible order, requirement, decision or interpretation made by the Zoning or Code Enforcement Officer.

Application Process

Typical steps before a hearing

Contact zoning staff

Discuss the project and obtain any required determination, denial or referral.

Prepare the application

Complete Form ZBA-3 and assemble plans, surveys, photographs and supporting information.

Submit by the deadline

Provide the complete application, required copies and applicable fee before the published cutoff.

Attend the hearing

Present the request and respond to questions during the noticed public hearing.

Do not assume a monthly meeting will occur. The ZBA meets only when active matters are scheduled. Confirm the meeting date, filing deadline and hearing requirements with the Town before submitting materials.
Public Meetings

Meeting and hearing information

The ZBA generally meets on the fourth Thursday of the month at 7:00 PM at Milford Town Hall, but only as needed. Public hearings are scheduled and noticed for active applications.

Agendas, approved minutes and available case records can be reviewed through the Town’s Planning and Zoning document category. Applicants should verify notice, mailing and submission requirements directly with the Town.
