About the Court

Serving the Town of Milford

The Milford Town Court is part of New York State's Unified Court System. It handles matters arising within the Town's geographic boundaries, including vehicle and traffic cases, criminal matters, civil cases, landlord–tenant proceedings, small claims, local code matters, dog-control cases and certain environmental-conservation violations.

The court is independent from the Town Board and other administrative departments. Questions about a pending case, appearance date, plea, payment or filing should be directed to the court—not to the Town Clerk or Supervisor.

Before traveling: Court schedules can change because of holidays, adjournments or judicial availability. Call the court to confirm your appearance date and office availability.

Common court questions

Use these summaries as general procedural information. Your ticket, court notice and instructions from court staff take priority.

Vehicle and traffic tickets

How to answer a ticket

A motorist is responsible for responding by the date shown on the ticket. For a non-misdemeanor charge, you may generally appear as directed or enter a plea using the appropriate section of the ticket and mail it to the court.

Pleading guilty

Complete and sign the guilty-plea section. The court will process the plea and send further instructions, including any fine notice.

Pleading not guilty

Complete and sign the not-guilty section. The court will notify you of the next scheduled conference or trial date.

Misdemeanor charges: Do not rely on a mailed plea unless the court specifically authorizes it. Misdemeanor traffic charges generally require an in-person appearance.

Suspensions

Contact the court promptly if DMV says your license or driving privilege was suspended because of a Milford matter. You may need to answer an outstanding ticket, pay a court obligation, or complete another required step. DMV may also charge a suspension-termination fee; the amount depends on the type of suspension, so follow the amount and instructions in your DMV notice.

Paying fines and court fees
Personal checks are not accepted. Confirm the amount due and accepted payment method before sending payment.

Accepted payment options

  • Credit or debit card: Accepted in person, subject to the provider's service fee.

Landlord and tenant matters

The court hears qualifying landlord–tenant proceedings involving property within the Town of Milford, including nonpayment and holdover matters. Civil sessions are generally held on the first Tuesday at 6:00 PM, but the date assigned by the clerk or shown on the court papers controls.

Court staff cannot provide legal advice. Clerks may explain filing procedures but cannot tell a landlord how to evict a tenant or advise a tenant how to defend a case.
Small claims

Town and Village Justice Courts in New York may hear qualifying small claims seeking money damages up to $3,000. The defendant must generally reside, work, or have a place of business within the court's territorial jurisdiction, as allowed by law.

  • Small claims seek money only; they are not used to force someone to return property or perform an action.
  • Provide the defendant's complete physical address. A post-office box alone is not sufficient for service.
  • Individuals may file small claims. Business entities should review New York's commercial-claims rules or speak with an attorney.
  • Bring documents, photographs, receipts, estimates, contracts and witnesses needed to prove the claim or defense.
Claims up to $1,000

Source page lists a $10 filing fee. Confirm with the clerk before filing.

Claims over $1,000 to $3,000
